Trademark Objection
Once a trademark application is filed, it is examined by a Trademark Examiner, who reviews it and conducts a search for any existing trademarks that are identical or similar to the one applied for. The results of this review are documented in a Trademark Examination Report.
Use of Incorrect Trademark Form
If a trademark application is not filed using the correct form, the Trademark Examiner may raise an objection such as the following:
“The application is made on Form TM-1 for a certification mark in respect of goods or services falling under a class. The form of the application should be corrected to TM-4 by filing a request on Form TM-16.”
Corrective Action:
